The Council has been served writ reagding an act of Wreckless Endangerment more to follow on this
The fencing which has been put up is obstructing the bus stop and at one stage curtailed the ROW . Writ asserts an act of reckless endangerment by the Council Assett Management Department

The decision as whether the Proposed Village Green VG10 attains full status under thre Commons Registration Act as a Village Green will be deermined by an Independent Inspector , Mr Vivian Chapman QC , based on evidence for " Use of Right" on 20 years continuous use by the community
If the Green is sucessfull it will be a Victory for common people in securing and determining the use and value of their own environment which is valued for its recreational and sporting use
Bradford MDC would appear to be the only council that has an officer whose dedicated eole is to thwart Village green application. Currently the following signage is displayed on the Green only very recently installed ( June 2005) despite being used by the community for well over 20 years plus . These signs cost the tax payer and in the light of the recent Oxfordshire Trap Case are meaningless in respect of our application made one year previous - they do not retrospectfully negate 20 yrs continuous use ...
At thsi stage we draw attention to the Telegraph & Argus failure to provide coverage of this emerging land mark series of events

What are the function ?
These signs have been installed as a result of a case awaiting trial at the house of Lords known as " The Oxfordshire Trap Case " which will be the main determinant on Village Green Issues as it stands a current High Couryt ruling has assisted a land owner because of the nature of signage . The trap case will determine if such recent strategy can negate 20 years of continous use . The signs do not prohibit YOU from using the Village Green and you may continue as normal .
What Happens Now ?
Objection to the Green will have ended soon . It will be interesting to see who objects to this otherwise wasted piece of land since it is extensively used by the community. It is the intention of the Village Green Committe to improve the Green as a nature walkway from Woodside Primary School to the base of Brow Woods
Who Uses The Green ?
All members of the community as part of the application we gathered many forms establishing who used the Green , when and for what purpose. Valid uses include Walking , Jogging , Ball Games Pic Nics and other leuisure time activity. The Bus Stop which is sited on the Green has been used by peoplefor many tyears and have walked the Green to be able to use it,

Noticed !
It was note on the 14th July 05 that a small sign indicating site of Village Green kicked down , prior to a site visit by panel councillors , where the farmer was seen in the imdeiate area clearly unhappy above the impact of the Green on the devlopent but what about the othere point of view . How will the developemnt impact on the Green !!! Childish really
The Story So Far.....
Well after a promising start with Gerry Sutcliffe MP saying he would write a letter of full support on behlf of the initial 2000 or so Community Signatures 3 weeks before the election we are now told that Gerry Can't because ...well we don't exactly know as he has gone dreadfully quiet .....but not un-noticed . Well thanks for nothing Gerry
In the meantime the matter is referred to an independent Barrister ( appointed by the Council of Course ) for aruling and subsequent recommendation on return to the Paragon of Planning , Bradford Councils Licencing panel .
Since we dont have much faith in the council we are set to challenge watch this space ............................
