Bats are a protected species .many such are seen to migrate alomg the field boundaries and tree lined hedgegrow and corridors around the fields at Fenwick Drive . Despite achieving legal protection in Law the countryside Officer has alluded to planting a tree lined corridor at the top of the hill. We have pointed out to the Countryside Officer that this is an unrealistic strategy since NGT Powerlines would prohibit the integrity of this corridor and not aloow for any planting

What the UDP and Countryside Officer Should Have Identified

POLICY NE 13

 

DEVELOPMENT THAT WOULD ADVERSELY AFFECT THE INTEGRITY AND
VALUE OF THE WILDLIFE CORRIDOR NETWORK ACROSS THE
BRADFORD DISTRICT OR THE MOVEMENT OF FLORA AND/OR FAUNA
SPECIES WITHIN WILDLIFE CORRIDORS WILL NOT BE PERMITTED.
PROPOSALS INVOLVING LAND IDENTIFIED ON THE PROPOSALS MAP
AND PROPOSALS AFFECTING OR ADJACENT TO ALL WATERCOURSES
AS PART OF A WILDLIFE CORRIDOR SHOULD MAKE PROVISION FOR THE
RETENTION OF THE CORRIDOR AND PROTECTION OF ITS WILDLIFE
LINKS.

POLICY NE9

 

DEVELOPMENT LIKELY TO HAVE AN ADVERSE EFFECT ON A SITE OF
ECOLOGICAL/GEOLOGICAL IMPORTANCE (SEGIs & RIGS), OR A SITE OF
LOCAL NATURE CONSERVATION VALUE (BRADFORD WILDLIFE AREASBWAs),
AS SHOWN ON THE PROPOSALS MAP (OR SUBSEQUENT
REVIEWS), WILL NOT BE PERMITTED UNLESS IT CAN BE CLEARLY
DEMONSTRATED THAT THERE ARE REASONS FOR THE PROPOSAL
WHICH OUTWEIGH THE NEED TO SAFEGUARD THE SUBSTANTIVE
NATURE CONSERVATION VALUE OF THE SITE. WHERE DEVELOPMENT
IS PERMITTED WHICH WOULD DAMAGE THE NATURE CONSERVATION
VALUE OF THE SITE, SUCH DAMAGE WILL BE KEPT TO A MINIMUM.
WHERE APPROPRIATE THE AUTHORITY WILL CONSIDER THE USE OF
CONDITIONS AND/OR PLANNING OBLIGATIONS TO PROVIDE ADEQUATE
MITIGATION.

 

POLICY NE11

 

DEVELOPERS WILL BE REQUIRED TO PRODUCE AN APPROPRIATE
ECOLOGICAL APPRAISAL FOR ALL PROPOSALS ON OR ADJACENT TO A
DESIGNATED NATURE CONSERVATION SITE OR WHICH COULD AFFECT
PROTECTED SPECIES, SAC NATURAL HABITATS OR OTHER
SPECIES/HABITATS OF CONSERVATION CONCERN AS LISTED ABOVE.
EXPERT SURVEY AND SPECIALIST ADVICE SHOULD BE SOUGHT WHERE
NECESSARY.

 

POLICY NE4


THE COUNCIL WILL SEEK TO PRESERVE AND ENHANCE THE
CONTRIBUTION THAT TREES AND AREAS OF WOODLAND COVER MAKE
TO THE LANDSCAPE CHARACTER OF THE DISTRICT, (INCLUDING THE
AMENITY VALUE OF TREES IN BUILT UP AREAS). IN PARTICULAR THE
COUNCIL WILL:
(1) RESIST DEVELOPMENT PROPOSALS WHICH WOULD RESULT IN
THE LOSS OF TREES

(a) THE CHARACTER OF THE LANDSCAPE;
(b) THE CHARACTER OF A SETTLEMENT OR ITS SETTING;
(c) THE AMENITY OF THE BUILT UP AREA, OR
(d) PROVIDE VALUABLE WILDLIFE HABITATS.
(2) MAKING TREE PRESERVATION ORDERS WHERE NECESSARY TO
PROTECT TREES AND WOODLAND AREAS WHICH CONTRIBUTE TO
LOCAL AMENITY OR LOCAL LANDSCAPE CHARACTER;

(3) PROMOTING AN INCREASE IN TREE AND WOODLAND COVER IN
APPROPRIATE LOCATIONS, AS DEFINED BY THE WOODLAND
STRATEGY AND REQUIRING DEVELOPERS TO CONTRIBUTE TO THE
OBJECTIVES OF THE WOODLAND STRATEGY AS PART OF THEIR
DEVELOPMENT PROPOSALS;

(4) ENCOURAGING WOODLAND MANAGEMENT AND TREE AND
HEDGEROW PLANTING SCHEMES BY LANDOWNERS, VOLUNTARY
ORGANISATIONS OR OTHERS, INCLUDING SECURING EFFECTIVE
WOODLAND AND TREE MANAGEMENT AS PART OF DEVELOPMENT
PROPOSALS.

 

How Does This Apply To the Site and The UDP Appraisal ?

Part of the Planning Site is a BWA 26 ( Bradford Wildlife Area ) which is a third tier conservation site which like many other facts on this site was included in error . We find this hard to believe .

The site appraisal has by and large changed from " A foraging corridor with significant ecological value adjacent to semi ancient woodland " to " A plantation adajiacent to semi improved agriculture " quite a rapid reversla in view I think you would agree.

 

More importantly the whole appraisl of this area on a UDP consideration should consider NE13 in the context oof Calderdale . The scheduled developements will effectively truncate this woodland corridor which has at its terminus a water body ( Royds hall Dam ) . Freswater is essential to all animals but in partucular bats and Deer which have and are dependent on this particular body of water .

Bradford Countryside Officer has also failed to acknowledge concerns regardingthe planting of any tree corridorsmin the light of over head cables . Development planners will be asked to account for their action regarding these matters
